Quick answer: The mandatory retirement age in Kenya’s public service is 60, or 65 for public officers with a registered disability. TSC teachers retire at 60, and judges at 70 (they can choose to go from 65). The NSSF pensionable age is 60, with early retirement allowed from 50. Private employers have no single legal retirement age; your contract and pension scheme rules decide it.

Public Service: 60, or 65 for Persons With Disabilities

The National Treasury’s pensions FAQ states it plainly: “The mandatory retirement age in the Public Service is 60 years.” It adds that public officers with disabilities who are registered with the National Council for Persons with Disabilities retire at 65.

The Public Service Commission’s regulations set out the same ages and add a third category: lecturers and research scientists in public universities, research institutions and similar bodies retire at an age the Commission sets in consultation with those institutions. Under section 80 of the Public Service Commission Act, an officer retires on the date they reach the mandatory age, and their service can’t simply be extended. The Act does allow a retired officer to be engaged on contract if they have rare knowledge, skills and competencies that the service needs, they are willing, and age won’t impair their performance.

Conditions for retiring at 65 with a disability

The extra five years are not automatic. Under the Commission’s regulations, an officer is considered for retirement as a person with disability if they:

  1. Have a permanent disability that has a substantial effect on their ability to carry out ordinary day-to-day activities
  2. Have been registered in their employer’s human resource database as a person with disability at least three years before their retirement date (the Commission can consider cases where the disability arose later)
  3. Are registered with the National Council for Persons with Disabilities and hold a KRA tax exemption certificate as a person with disability

Registration with the Council alone is not treated as automatic proof. Where there is doubt, the Commission asks the Director of Medical Services for a second medical assessment. Because of the three-year rule, an officer who acquires or discloses a disability late in their career should update their HR records as early as possible.

When public servants can draw a pension

According to the Treasury, the qualifying service for a public service pension is 10 years and the qualifying age is 50. That means a pensionable officer who leaves at 50 or later with 10 years’ service can draw a pension, even though the compulsory exit is 60.

Teachers: 60

The Teachers Service Commission says compulsory retirement “applies to teachers who have attained 60 years”. TSC issues a retirement notice two years before the retirement date, though it can give shorter notice in special circumstances. After receiving the notice, a teacher should:

  • Send all the documents listed in the notice promptly
  • Give full bank account details on the bank forms
  • Choose whether to commute part of the pension, up to a quarter
  • Confirm their tax status with KRA and settle any tax due

Teachers with a disability should ask TSC how the public service rule on retirement at 65 applies to them, well before the notice period starts. Check your service records on the TSC online services portal, and see how pay is built up with our TSC salary calculator.

Judges: 70

Article 167(1) of the Constitution says a judge must retire at 70 but may choose to retire at any time after turning 65. This applies to judges of the superior courts. Read more about the functions of the Judiciary.

NSSF: Pension at 60, Early Retirement From 50

Under the NSSF Act, 2013, the pensionable age is 60. The Act says a retirement pension is payable to a member who has reached pensionable age, or who has opted for early retirement after turning 50 but before reaching pensionable age.

NSSF’s own benefits page also describes other routes:

  • Invalidity: for members certified as permanently unable to work, and for members aged at least 50 with a permanent partial incapacity that stops them working
  • Emigration: for members leaving Kenya for a country outside the East African Community with no plan to return
  • Survivors: paid to dependants of a member who dies

The same page still describes an age benefit from 55 under older rules. If you have NSSF savings from before the 2013 Act took effect, ask NSSF which rule applies to each part of your balance. See our guides to NSSF contribution rates, NSSF Tier I vs Tier II and NSSF benefits claims.

Private Sector: Your Contract and Scheme Rules Decide

Kenya’s employment law does not fix one retirement age for private employers. Your retirement age is whatever your employment contract, HR policy or collective bargaining agreement says, together with the rules of your pension scheme. Check your own letter of appointment and scheme booklet for the exact age.

Scheme rules also set an early retirement age. For income drawdown and early access, the retirement benefits rules put that at age 50 at the earliest. If you leave a job before your scheme’s early retirement age, the Retirement Benefits Authority’s guidance allows you to take up to 50% of your total benefits, with the rest preserved. Read our guide to pension withdrawal rules when you leave a job and how income drawdown works.

Planning Ahead

  • Confirm your exact retirement date with HR at least two years ahead.
  • Check that your NSSF and scheme statements show every year of service.
  • Decide early whether you want a lump sum, an annuity or drawdown, and check the tax on each.
  • Project your income with our retirement calculator.
