Power of Attorney Kenya: A Guide for Diaspora

Power of Attorney Kenya: A Guide for Diaspora

Updated 27 October 2026

If you live abroad and need someone in Kenya to buy or sell land, sign a lease, deal with a bank or follow up on a title for you, the usual tool is a power of attorney. Kenya registers these at the Lands Registry. It is a written document in which you (the donor) authorise another person (the attorney or donee) to act for you. Done well, it saves you flights home. Done carelessly, it is one of the main routes to land fraud against diaspora Kenyans. This guide explains the types, how to sign one abroad, when it must be registered, and how to limit the risk.

Updated October 2026.

Sources: Registration of Documents Act (Cap. 285), Land Registration Act, 2012 and Ministry of Lands registration practice. Checked on 27 October 2026. General information, not legal advice; have a Kenyan advocate draft and check yours.

General vs specific power of attorney

General power of attorney Specific (limited) power of attorney
Scope Broad authority over many of your affairs One task or one property, such as selling plot X or collecting a title
Risk High: the attorney can do almost anything you could Lower: limited to what is written
Best for Long absences where someone must run your affairs Most diaspora land and bank tasks

For land, choose a specific power of attorney that names the parcel number, lists exactly what the attorney may do (for example “sign the transfer and collect the new title”), and sets an end date.

What a good power of attorney should say

  • Your full name, ID or passport number and address, and the same for the attorney.
  • The exact powers granted, in clear terms. Avoid “to do all such things as may be necessary”.
  • The property involved: title or parcel number, location and size.
  • Whether the attorney may receive money, and into which account. Ideally, require proceeds to go to an account in your own name.
  • The date it starts and the date or event when it ends.
  • Whether the attorney may appoint someone else (usually no).

How to sign a power of attorney abroad

  1. Have it drafted by a Kenyan advocate so it fits Kenyan registration requirements.
  2. Sign it in front of an authorised witness. Documents signed outside Kenya are usually executed before a notary public and then authenticated, or signed before a consular officer at a Kenyan embassy or high commission. Ask your advocate which form the Kenyan registry will accept for your country.
  3. Send the original to Kenya by courier. Registries work with originals, not scans.
  4. Pay stamp duty and register it through your advocate.

When must it be registered?

A power of attorney that will be used to deal with registered land should be registered. The Land Registration Act, 2012 provides for powers of attorney to be registered at the land registry before a registrar acts on any document signed under them. Powers of attorney may also be registered under the Registration of Documents Act. In practice, a land registrar will want to see a registered power of attorney before accepting a transfer, charge or lease signed by an attorney.

Registration also creates an official record, so anyone dealing with your attorney can check that the authority is genuine and still in force.

How to revoke a power of attorney

You can cancel a power of attorney by signing a revocation (deed of revocation) and registering it in the same registry where the power was registered. Tell the attorney, your bank and anyone else who has dealt with them in writing. Until the revocation is registered and people are told, others may still rely on the old authority. A power of attorney also generally ends on the donor’s death.

Seven ways to protect yourself

  1. Choose a person with no financial interest in the deal, not just the nearest relative.
  2. Limit the power to one task, one property and a short time.
  3. Require that any money goes into an account in your name; see how to open a Kenyan bank account from abroad.
  4. Do your own official search on the land before and after the transaction; our ArdhiSasa land search guide shows how.
  5. Use your own advocate, not the buyer’s or seller’s.
  6. Ask for copies of every document the attorney signs.
  7. Revoke and register the revocation as soon as the task is complete.

Power of attorney Kenya: frequently asked questions

Can I sign a Kenyan power of attorney abroad?

Yes. It is normally signed before a notary public and authenticated, or before a consular officer at a Kenyan mission. Confirm the accepted form with your Kenyan advocate.

Does a power of attorney for land need to be registered?

Yes, in practice. A land registrar will want a registered power of attorney before acting on documents an attorney signs.

Can the attorney sell my land without telling me?

If the power allows it, yes. That is why powers for land should be specific, time-limited and require proceeds to go to your account.

How do I cancel a power of attorney?

Sign a revocation and register it where the power was registered, then notify the attorney and anyone who dealt with them.
